Homie Insurance - Service Terms

The following Service Terms (“Service Terms”) apply to all Services provided by Homie Insurance Agency, Inc. d/b/a Homie Insurance (“Homie Insurance”), and are hereby incorporated into Homie Insurance’s General Terms and Conditions (“T&Cs”) provided by :

  1. Insurance Services and Administration. User understands and agrees that Homie Insurance is a licensed insurance agency, and as such User understands and agrees that Homie Insurance assists users in obtaining many different insurance products based upon information User submits.

  2. User’s Responsibilities & Obligations. Homie Insurance cannot and does not make any decisions for User, and it is User’s responsibility to verify all information given to and provided by Homie Insurance. User agrees that User will make sure all data is accurate and in User’s best interest before signing any policies, contracts, or any forms provided to User by Homie Insurance. User expressly acknowledges and agrees that User alone is responsible for the content of any document User signs. User is solely responsible for complying with the terms and conditions contained in any such document, including providing additional information, and User alone is responsible for the consequences of any nonperformance required under such documents. Before executing any document by or through the Services, Homie Insurance recommends that User contact an appropriate independent professional to answer any questions User may have. By physically or electronically signing any such documents produced or transmitted through the Services, User expressly represents and warrants that User has read and that User understood all provisions contained therein.

  3. Third-Party Service Providers. Homie Insurance uses third party service providers, vendors, and licensors (“Third Party Service Providers”) to assist in providing the Services. User hereby consents and authorizes Homie Insurance to delegate the authorizations User provides to Homie Insurance to Homie Insurance’s Third-Party Service Providers to provide the Services to User. User agrees that the T&Cs, including these Service Terms and any other agreements, conditions, warranty disclaimers and liability disclaimers incorporated into this Agreement, inure to the benefit of such Third-Party Service Providers and such Third-Party Service Providers are deemed to be third-party beneficiaries of this Agreement, including any other terms, conditions, warranty disclaimers and liability disclaimers incorporated into this Agreement. User also agrees that all references to Homie Insurance within this Agreement and any incorporated terms are also deemed to include, where applicable, our agents, such as the Third-Party Service Providers. User’s use of certain services provided by Third-Party Service Providers may require User’s agreement to certain additional terms and conditions provided by the applicable Third-Party Service Providers. These additional terms and conditions will be made available to User when, and if, those Third-Party Service Providers require separate acknowledgement from the User. User agrees to indemnify Homie Insurance, and all of its affiliates, employees, and directors from any liability arising from a claim related to these additional terms and conditions required by the Third-Party Service Providers.   4. Payment Terms. All payments are for services of Third-Party Service Providers. User understands and agrees that annual or bi-annual payments made to Third-Party Service Providers shall be paid directly to the Third-Party Service Provider. In the event that User chooses month-to-month payments, User agrees to arrange direct withdrawal payments with the Third-Party Service Provider. In the event that User cannot make payments directly to the Third-Party Service Provider, payments can be mailed to the main office of Homie Insurance. Payments that are mailed in shall be immediately deposited in Homie Insurance’s trust account, from which the Third-Party Service Provider shall make debits for the payments of services. In person payments may take several days to clear the trust account. In the event of any disruption of Third-Party Service Provider services due to payment issues, User agrees to hold Homie Insurance, and any of its affiliates, employees, and directors harmless for any damages incurred.

  5. Billing Issues. User must notify Homie Insurance about any billing problems or discrepancies within 90 days after charges first appear on User’s account statement. User agrees to waive User’s right to dispute any problems or charges if not brought to Homie Insurance’s attention within 90 days of the occurrence of such problems or charges.

  6. Limitation of Liability. Homie Insurance expressly disclaims any liability for, and User further agrees to indemnify Homie Insurance in connection with, any dispute arising out of or related to User’s use of the Services and the content of, and User’s compliance or non-compliance with, any documents produced or transmitted by or through the Services. By signing any documents produced or transmitted by or through the Services, User expressly releases Homie Insurance from any liability (i) in connection with the content, legality and enforceability of such documents, (ii) related to the subject matter thereof, or, (iii) arising out of the transactions contemplated therein.
  7. Service Cancellation. User may cancel User’s application at any time by contacting Homie Insurance at service@homieinsure.com. If there has been no activity or response from User regarding the Services for a period of more than 30 Days, Homie Insurance reserves the right to remove such application in its sole discretion. Homie Insurance will remove any applications where timely payment has not been made or has been revoked.
